VILLAGE OF ST. HELENA

PLANNING BOARD MEETING OF May 2, 2013

The meeting was called to order at 6:30 p.m. by Chairman Jimmy English.  Present were Chairman Jimmy English, Gerald Velie, Teresa Coleman, Melvin James, Katrina Banks, Mack Smith, and Village Inspector Louis Hesse.  Mr. Corbett said he would be available by phone if needed.

The minutes from the April meeting were read and unanimously approved on motion by Melvin James and seconded by Katrina Banks.

The Planning Board readdressed the typographical errors in the UDO from the previous month’s meeting.  The following issues were discussed.

Section 2-5(I) refers to itself.  The end should read “as provided for under Section 5-4.

Section 3-2 (41) and (42) both refer to RA-20 manufactured home zoning district, which no longer exists.  RA-20 should be changed to RA.

Article 10-2

Accessory Uses/Accessory Building (f.n.5) – refers to Section 14-9 which does not exist.  It should refer to Article 11.

It was also noted that there was a discrepancy between the amount of allowable floor space allowed under Accessory Structure (f.n.4) and Home Occupations (f.n.6) (3).  It was decided that they are two different categories and therefore no change was recommended.

There was also a discrepancy with the written word and numbers provided under Home Occupations (f.n.6) (4).  It was decided that “thirty-five percent of the total floor area or seven hundred fifty square feet” be recommended.

Adult Businesses (f.n.7) refers to Article 21.  This should be changed to Article 12.

Family or Group Care Homes (f.n.8) – the reference to Section 4-9 should be deleted as Sec. 4-9 refers to the duties of the Building Inspector, Board of Adjustment, Courts, and Village Council as to matters of appeal and is irrelevant.

Yard Sales (f.n.17) refers to Section 14-9 which does not exist.  It is recommended this be deleted.

Dumpster Screening (f.n.18) refers to Section 14-9 which does not exist.  It is recommended this be changed to Section 11-1, Note 7.

Section 13-4 refers to Appendix I which does not exist.  It is recommended this be changed to Section 12-9.

Section 21-9(S) refers to Appendix I which does not exist.  It is recommended “Appendix I” be deleted.

Section 22-1 – it is recommended that this be removed.

Section 22-2 – the Planning Board requests the amended version from Mr. Corbett before making any recommendation.

Article 24 – it is noted that in the November 2012 minutes, Mr. Corbett informed the Planning Board that Article 24 had been reinstated as part of the UDO.

In the Table of Permitted Uses, Automobile Service Stations has a f.n.9.  F.N.9 refers to jails and it is recommended this footnote be deleted.

Section 16-16 (F) – “a maximum grade of twelve percent (12%)” is recommended.

There was also a question about the wording used referring to Church, Club, or Private Lodge in Section 3-2 (11) and also the difference in the definition of a family care home referred to in Section 10-2 f.n.8 and in Section 3-2 (22).  It was decided to defer any recommendation until we could confer with Mr. Corbett.

On motion by Gerald Velie and seconded by Katrina Banks, the Planning Board unanimously agreed to appeal the Village Council’s attendance policy regarding compensation.  At the present time, there are no excused absences of any kind.
