Proposed "Family Subdivision"

Section 20-1

(A) General

No final plat of a subdivision within the jurisdiction of Saint Helena as established in Section 2-2 of this Ordinance shall be recorded by the Register of Deeds of Pender County until it has been approved by the Village Council as provided herein. To secure such approval of the final plat, the subdivider shall generally follow the procedure established in this section.

(B) Family Division

a) Limitations

I. Family Subdivisions are permitted on parcels that have been created and recorded in the Registry before August 19, 2003.

II. A total of three  parcels* (excluding the remnant parcel, if the remanant parcel meets the requirements of this Ordinance) per division.

III. The division does not create a new public or private road.

b)  Requirements

I. The plat shall be clearly designed “Family Subdivision” in bold letters,

II. The Grantor and Grantee statement (see below), located in Appendix A, shall appear on the plat and be signed by the Grantor(s) and Grantee(s) prior to approval.

III. Certification by the licensed Professional preparing the plat that each lot is adjacent to a natural drainage way or perennial stream or a 20 ft. drainage easement is recorded from each lot towards a natural drainage way or perennial stream or if the lot or lots front a NCDOT maintained road, approval from NCDOT for such lots to drain to a public road,

IV. The plat shows any designated Special Flood Hazard Areas located within the Subdivision,

V. The plat shows any designated Areas of Environmental Concern located within the subdivision,

VI. The lots, other than those restricted for building development, shown on the plat meet the requirements of the Ordinance.

*Number of parcels may be subject to change.

GRANTOR/GRANTEE CERTIFICATE

The following statement shall appear on the plan and be signed by the Grantor(s) and Grantee(s) prior to approval:

The Grantor(s) and Grantee(s) certify that the Grantee(s) is within three (3) degrees of Collateral kinship* of the Grantor(s), and that the purposed of this wavier is not to circumvent the provisions of the Village of St. Helena Unified Development Ordinance, and that none of the lots shall be conveyed to non-family members for a period of not less than five (5) years.
