MINUTES Village of St. Helena Public Hearing/Council Meeting October 20, 2011
Present were Mayor Robert Barnhill, Ron Rampone, Neil Benton, Jim Davis, Nancy Jones, Willie Knowles, R. H. Corbett, Louis T. Hesse, and Chad McEwen. Also attending were Gerald Velie, Judy Katalinic, Brian Riportella, Joyce Smith, William Hunter, Kathy Hone, and Holly Riportella. At 6:00 P. M. Mayor Barnhill opened the hearing. The hearing was to receive evidence concerning the petition of Brian Riportella for a conditional use permit to board and train horses on the property located at 432 North West Avenue , St. Helena , North Carolina (Pender County Assessor’s parcel number 3228-22-8119-0000) and that described as St. Helena Farm Number 252 (Mapbook 3, at page 27, Pender County Registry) and given PIN 3228-22-5359-0000 by the Pender County Assessor. The council will hear evidence concerning the granting of the petition and, if the petition is granted, what conditions will be imposed upon the use. Louis Hesse remarked that all three parcels would have the same conditions. On motion by Ron Rampone, and seconded by Nancy Jones, the hearing was adjourned unanimously. were approved At 6:30 P. M. Mayor Barnhill called the regular meeting to order. Willie Knowles prayed. Louis Hesse asked that September minutes be corrected as follows: the horse farm would operate during daylight hours except from May to November extended hours 5-11 P.M. Security lights would be the sodium type. On motion by Willie Knowles, and seconded by Ron Rampone, minutes of September 15, 2011 and September 29, 2011 were approved unanimously after the correction. On motion by Willie Knowles, and seconded by Ron Rampone, the financial report was approved unanimously. Louis Hesse advised that DOT is permitting campaign signs on highway rights-of-way. Mayor Barnhill commented on Powell money. If a town’s population is under 5,000 a request can be made to use 20 years instead of 10 for the balance on hand. On motion by Jim Davis, seconded by Ron Rampone, the Ordinance of October 20, 2011, a copy of which is attached and hereby made a part of these minutes, was passed by a vote of four in the affirmative and one in the negative. Joyce Smith representing St. Joseph ’s Church requested that the Council give permission for sewer to be available to the church from Burgaw. Chad McEwen said that Burgaw would not look at it until the Village of St. Helena considered it. Kathy Hone said that the problems were worse, asking for strong consideration since the church did a lot for others. Mayor Barnhill said that it had been denied for Mahindra tractor place. Mayor Barnhill and Nancy Jones felt it would have to be provided for all. There was no motion to act upon this. On motion by Willie Knowles, and seconded by Ron Rampone, the meeting was adjourned unanimously. Respectfully submitted, Mary D. Bakan, Village Clerk - ORDINANCE OF OCTOBER 20, 2011 AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT TO PARCEL IDENTIFIER NUMBERS 3228-22-8119-0000, 3228-21-7903-0 000 AND 3228-22-5339-0000 AS GIVEN BY THE PENDER COUNTY ASSESSOR WHEREAS:
1. Brian Riportella and wife Holly Riportella are the owners of those parcels described in the deed recorded in Deed book 3941, at page 101, of the Registry of Pender County, North Carolina, and given parcel identifier numbers 3228-22-8119-0000 and 3228-21-7903-0000 by the Pender County Assessor; 2. Linda L. Croom is the owner of the parcel described in the deed recorded in Deed Book 3466, at page 242, of the Registry of Pender County, North Carolina, and given parcel identifier number 3228-22-5359-0000; 3. Brian Riportella and wife Holly Riportella have an agreement to buy the foregoing parcel from Linda L. Croom; 4. Brian Riportella has applied to the Village of St. Helena for a conditional use permit to board and train horses on the foregoing properties; 5. Linda L. Croom has joined in the application; 6. Brian Riportella and Linda L. Croom have standing to make such application; 7. The above properties are located within an R-20 zone; 8. The above proposed uses are conditional uses within that zone; 9. The Village of St. Helena Planning Board has considered the application and made its recommendations to the Village Council; 10. A public hearing was held upon due notice; and, 11. The Council has made the following specific findings: a. The applied for use will not materially endanger the public health , safety or general welfare if located on the foregoing parcels and developed according to the plan in the application; b. The applied for use can meet the following conditions: i. The facility may serve no more than twenty (20) horses at any given time; ii. Operation of the facility for training shall occur only during daylight hours except from 5:00 A. M. to 11:00 P. M. during the period of May 1 to November 1 of each year, iii. No more than four (4) security lights may be located on the parcels, which lights must be sodium, and iv. The granted permission will be for a use for one operation to be located on the three parcels; c. The applied for use will not adversely affect the use or physical attributes of adjacent properties; d. The location and character of the applied for use will be in harmony with the area in which the above parcels are located and the use in this location is in conformity with the Village of St. Helena Land Use Plan .
NOW THEREFORE IT IS ORDAINED THAT effective October 20, 2011, permission is granted to the above parcels for their use as a horse boarding and training facility, subject to the conditions set forth in the premises hereof, and the Village of St. Helena Zoning Administrator is authorized and directed to issue a permit evidencing this permission. This the 20th day of October 2011.
